Newalla Man Charged With Attempting to Lure Child

According to a probable cause affidavit for arrest, Brian Frutchey of Newalla used the Internet in an attempt to entice an underage girl into a secret meeting. That ‘girl’ was a Blaine County undercover investigator.

The investigator created a profile on a chat app identified as ‘Macie’ a 15year-old. Frutchey is 40.

Part of the computer conversations included Frutchey verifying ‘Macie’s’ age as 15 ½. Other excerpts are discussions explicit in nature and that he ‘always wanted to fool around with someone younger.’

He also sent photos of his private parts via the app to the undercover officer.

Thereafter, the undercover officer made arrangements to come to the Luther location where Frutchey worked.

That was enough for the issuance of an arrest warrant, which was executed by the Luther Police Department.

He is charged with making a lewd or indecent proposal to a child under 16 for the child to have sexual relations with any person, when the accused is more than three years older than the victim; Inviting, enticing, persuading a child less than 16 years old to go to a secluded, remote or secret location for the purpose of committing a crime, when the accused is more than three years older than the victim; Shows, exhibits, loans or distributes to a minor any obscene material or child pornography for the purpose of inducing the child to participate in obscene conduct; communicate with, store data in or retrieve data from a computer for the purpose of violating provisions of the Oklahoma statutes. These are both state and federal felony charges.

If convicted, Frutchey could face up to 20 years each on the four counts, with a minimum sentence on conviction of three years each.
